PIP litigation in France: good news for victims

GJN member Jean Pierre Bellecave, GJN board member Carlos Villacorta with Rebeca Martinez and Kathleen Doyeux and the entire team of BCVLEX tell us more about two recent judgements from the Supreme Court of France.

Several cases were subject to a suspension in France, pending the outcome of an appeal before the Court of Cassation, related to the period of lability of TUV in the PIP silicone breat implant litigation.

The Court of Cassation rendered several decisions on May 25. One of the appeals concerned the decision issued by the Court of Appeal of Versailles (January 14, 2021) which had denied any liability of TUV: this Appeal decision has now been cancelled by the Court of Cassation.

A second Court of Cassation’s decision of May 25, 2023 rejected the Appeal filed by TUV against the decision of the Court of appeal of Paris, which had admitted the different actions of the victims,
while cancelling the limitation period of responsibility (i.e 1 st September 2006 to 2010).

Such recent positioning of the Court of Cassation improves the perspective for many victims, though it will be necessary to celebrate a new appeal trial.

Several nationalities of victims are represented within the actions brought in French courts in cooperation between lead plaintiff attorneys of BCVLEX and those GJN members representing the victims at the domestic level, i.e. Italy, Germany.
